Privacy Policy

01.General

These Privacy Policy terms apply to all use of the Take2 website at https://take2.live and any service, system, application, interface or digital platform operated within it or through it from time to time (together: the "Platform" or the "Site").

Browsing the Platform, using it, registering for it, posting content or items, selling, buying or any other action through it, constitute the User's confirmation and consent to the terms of this Privacy Policy, which forms an integral part of the Platform's Terms of Use published at https://take2.live/terms.

There is no legal obligation to provide personal information to Take2 or to use the Platform; however, without providing certain information it may not be possible to use some of the services, benefits, functions or activities offered within the Platform.

Take2 does not knowingly collect personal information from minors without the consent of a parent or guardian where such consent is required by law. If Take2 becomes aware that such information was collected without the required consent, Take2 may delete this information, restrict access to certain services or take additional measures at its discretion.

In this policy, "personal information" is as defined in the Protection of Privacy Law, 5741-1981 (the "Privacy Law"): data relating to an identified person, or to a person identifiable with reasonable effort, directly or indirectly, by means of an identifier such as their name, ID number, location data about them, a biometric identifier, online identifiers of their end devices, or by means of a detail relating to their physical, economic, health, social or cultural condition. This law, and the regulations thereunder, set rules for the lawful processing of personal information.

02.What Information We Collect

Information Provided by the User

As part of using the Platform, the User may provide Take2 with personal information proactively, including:

  • registration and account details, such as first and last name, email, phone number and password;
  • login details via third-party identification services (such as Google and Facebook), in accordance with the permissions the User chooses to grant;
  • additional profile details as displayed in the registration forms or profile (e.g. profile picture and display details);
  • information provided when contacting Take2, including the content of the inquiry and correspondence;
  • content the User uploads or submits within the Platform, including item details, item descriptions and images;
  • information the User provides in communications with other Users on the Platform (such as messages, feedback, ratings and complaints);
  • details required to carry out a transaction at the User's choice, such as shipping details and billing/payment details as entered during the process (where processing of the payment itself may be carried out via external payment providers).

Information Collected During the User's Activity on the Platform

Take2 may collect and process information relating to the User's activity on the Platform, such as: actions performed in the account (including creation, settings updates and logins); item and listing data (including category, description, condition, price and images); search and browsing data on the Platform (including item views, saving/marking items and display preferences); communication and interaction data with other Users within the Platform (including messages, inquiries, feedback and ratings); transaction data and transaction status (including orders, cancellations, refunds, disputes and complaints); and shipping/delivery data related to the transaction (including choice of shipping method, collection/delivery details and tracking numbers, where offered).

In addition, Take2 may create and process derived data and analytical information from the User's activity on the Platform, such as usage and engagement metrics, usage statistics, and browsing and action patterns (in a manner that is not necessarily identifying), for the purpose of managing and operating the Platform, monitoring its integrity, information security and prevention of fraud and misuse, performance measurement and improvement of the services.

AI-Based Tools

AI tools are integrated into the Platform. Depending on the manner of use of the Platform, information and content related to the User's activity (including information provided by the User and information collected about her activity) may also be processed using these tools, among other things to operate the Platform and provide certain features, improve the services, secure them and prevent misuse.

AI-Based Characters & Content

The Platform may include, for illustration, inspiration, demonstration or impression purposes only, characters, avatars, images, videos, texts or other content created, processed or edited using AI systems, fully or partially. It is clarified that such content does not necessarily describe or represent a real person, item, product, event or circumstance, and shall not be regarded as a factual representation, undertaking, recommendation or promise by Take2. Where there is a resemblance between such a character or content and a real person, item, product, event or circumstance, such resemblance is coincidental only, unless expressly stated otherwise.

Information Regarding Transactions, Payments, Holding of Funds & Shipping

Take2 may collect and process information relating to transactions carried out through the Platform and the services accompanying them, including: transaction details, transaction status, payment and clearing details as received from external payment/clearing/escrow service providers (including statuses and confirmations, and generally without storing full card details at Take2), billing/credit and refund details, as well as information relating to shipping and logistics, such as shipping address, collection/delivery details, tracking number, shipping status and delivery confirmations as received from the relevant shipping providers. Such information may be used to operate the transaction, comply with legal requirements, prevent fraud, resolve disputes, customer service and secure the Platform.

User Content & Communities

The Platform may allow Users to post, upload, share, send or make accessible content, comments, messages, files, information, media or other content, including identifying details for items, images, descriptions, comments, ratings, feedback and messages between Users in connection with items or transactions ("User Content").

User Content may be visible, accessible or shared with other Users, third parties or the public, depending on the nature of the relevant service or platform, and any information the User chooses to publish within such services may become public.

It is clarified that Take2 is not obliged to proactively monitor, check or oversee User Content or communications between Users. However, to the extent information is brought to Take2's attention regarding activity, content or use that may breach the law, the Terms of Use, third-party rights or the integrity and safety of the Platform and services, Take2 may, at its discretion, carry out actions of checking, control, blocking, removal, restriction or enforcement, as it sees fit in the circumstances.

The User is fully and solely responsible for any User Content published by her and for any information she chooses to share within the Platform.

Technical, Statistical & Automatically Collected Information

When using the Platform, Take2 may collect technical and automatic information, including: information about Platform usage practices, pages, screens, content areas and services the User viewed or used, searches, item views, actions performed on the Platform, interactions with content and advertisements (where displayed), duration of stay and use on the Platform, frequency of use, activity times, source of arrival to the Platform, referrals to or from the Platform, engagement data, IP addresses, device identifiers, device type, browser type, operating system, network and communication data, Cookies and similar technologies, and additional statistical, technical and analytical information.

In addition, the Platform may integrate services, content and components of third parties, including identification services (such as Google and Facebook), payment/clearing/escrow services, shipping and logistics services, storage and cloud-infrastructure services, as well as analytics, measurement and advertising components (such as Google and Meta), which may collect information about the User in accordance with their privacy policy and terms of use.

03.The Database

The information collected about the User will be stored in Take2's databases and processed in accordance with this Privacy Policy, the Terms of Use and the law (the "Database"). Use of the Platform constitutes consent that the information will be stored and managed in Take2's databases for the purposes set out in this policy.

Take2 will retain the information for the period necessary to fulfil the processing purposes, operate the services, manage the Platform, comply with legal requirements, protect Take2's rights, prevent fraud, handle disputes and legal proceedings, or in accordance with any other legal obligation.

04.Use of the Information

Your personal information will be stored in the Database as stated, among other things, for the following purposes:

  • operating the Platform and the services offered within it as an online marketplace, including technological intermediation between Users for posting items, selling and buying;
  • registering Users, verifying their identity and managing user accounts;
  • providing the Platform's services, including display, publication, cataloging and marketing of items, managing records and statuses of transactions, and complementary services (such as photography/pricing/authentication/managed-sale services, where offered);
  • managing transactions and operational processes on the Platform, including payment/clearing mechanisms via external providers, escrow where relevant, verifications, handling reports of material discrepancy, cancellations, refunds, payment delays and dispute processes in accordance with the policy and Terms of Use;
  • tailoring the services and content to the user, analyzing User preferences, personalizing the user experience, activities, advertisements, recommendations and benefits, including according to usage patterns, areas of interest, favorite groups, interactive activity and usage habits on the Platform;
  • analyzing User behavior, measuring performance, conducting research, improving the services, improving the activity and benefit mechanisms, optimization and developing new services;
  • detecting, preventing, monitoring, investigating and handling prohibited or irregular activity, including impersonation, fraud, attempted fraud, use of an unlawful payment means, breach of the Terms of Use, harm to Take2, other Users or third parties, as well as monitoring usage patterns for security and prevention of misuse of the Platform;
  • information security, maintaining the Platform's integrity and protecting the rights of Take2, its users and third parties;
  • customer service, technical support and handling User inquiries;
  • sending operational messages, alerts, updates and system notifications;
  • sending direct mail, marketing messages, offers, promotions, activities and advertising content, subject to the law;
  • compliance with legal requirements, orders and instructions of competent authorities.

Without derogating from the foregoing, Take2 may use aggregate, statistical, anonymous or non-identifying information for research, development, analysis, measurement, generating insights, improving services and developing new products and services.

05.Direct Mail & Marketing Messages

Take2 may send Users operational messages, updates, marketing information, offers, promotions, advertising content and direct mail via email, SMS, WhatsApp, push notifications or any other means of communication, in accordance with the law.

The User may request to remove herself from the marketing mailing lists at any time via the unsubscribe mechanism included in the messages or by contacting Take2.

Any information provided by you through the Platform is provided of your own free will and with your full consent, and use of the Platform shall constitute clear and explicit consent in accordance with sections 11 and 17 of the Protection of Privacy Law, 5741-1981 and section 30A of the Communications Law (Telecommunications and Broadcasting), 5742-1982.

06.Disclosure of Information to Third Parties

We may transfer personal information and additional information collected about the User in connection with use of the Platform to third parties, only to the extent reasonably required to operate the Platform as an online marketplace and to provide the services, or as set out below:

Without derogating from the foregoing, Take2 uses technical partners to operate the Platform. These partners may receive access to personal information to the minimal and necessary extent for providing their service, including: Supabase (data storage), Tranzila and Bit (clearing), Twilio (WhatsApp), Resend (emails), Google (Analytics and OAuth), and Cloudflare (DNS).

Also, as part of carrying out transactions on the Platform, sharing of information between Users may be required (for example between a seller and a buyer) in order to carry out the transaction, supply the item, coordinate collection/delivery, shipping, customer service and dispute resolution; accordingly, contact details and/or shipping details may be displayed to the other party to the transaction as reasonably required to carry out the transaction.

In addition, we may disclose information to third parties also in the following cases:

  • to the extent required for the proper provision of the Platform's services, including transferring details to suppliers and service providers involved in operating the Platform, such as infrastructure and cloud providers, information security, analytics, customer service and communications, as well as payment/clearing/escrow service providers and shipping/logistics providers (including for issuing labels, shipping, tracking, delivery confirmation and fault handling). It is clarified that such information may be transferred, stored or processed outside Israel, including in countries where the level of data-privacy protection differs from that in Israel;
  • where the transferred information does not include details that would allow identifying you personally;
  • if required to do so under a judicial order, a demand of a competent authority or by law;
  • if we receive a warning of legal proceedings against us for actions carried out by you, as well as in any dispute, claim, demand or legal proceedings, if any, between you and Take2;
  • if Take2 reorganizes its activity and/or the Platform's activity and/or within another entity — including a merger with another entity and/or acquisition of activity, as well as within negotiations and due-diligence in connection with such transactions — it shall be entitled to transfer to the other entity the personal information or any other information accumulated about you, provided that the other entity undertakes toward you the provisions of this section;
  • if a claim is raised or a suspicion arises at Take2 that you have committed an act and/or omission that harms and/or may harm it and/or anyone on its behalf and/or any third parties;
  • if a claim is raised or a reasonable suspicion arises at Take2 that you have used the Platform to commit an unlawful act and/or to enable, facilitate, assist and/or encourage the commission of such an act;
  • if a claim is raised or a reasonable suspicion arises at Take2 that you have breached any of the Terms of Use and/or any agreement with Take2 and/or with anyone on its behalf;
  • to companies and organizations related to Take2, provided that they use the information about you only in accordance with this Privacy Policy, and in accordance with your consent or explicit request.

The User waives any claim or demand against Take2 and/or anyone on its behalf in connection with the disclosure of your details as stated.

07.Cookies & Similar Technologies

For the proper operation of the Platform and the services provided within it, including for the purpose of collecting information about the User's use of the Platform, verifying a User's identity, providing a more convenient and efficient user experience, analyzing and personalizing the Platform and the services provided within it to the User's needs and preferences, as well as for information-security purposes — Take2 uses and/or will use "Cookies", Pixels, Tags, Clear GIFs, Web Beacons and similar technologies.

Cookies are small text files stored via the browser or device used on the Platform. The cookies do not contain information that identifies you personally, but they may include information about your activity on the Platform and in connection with the services provided within it. You may choose, by changing the browser or device settings, to refuse to accept or store these cookies. However, the use of cookies allows the Platform and the services provided within it to deliver a more efficient user experience (including saving login state and preferences), and to collect statistical data about their use.

Take2 uses Cookies and similar technologies to operate and secure the Platform, save login state, save preferences (including language) and analyze usage and performance on the Platform, including via Google Analytics. Among other things, Take2 may use the following types of Cookies (and subject to the User's browser/device settings):

  • Essential / Session Cookies — Cookies required for the proper operation of the Platform, including logging into the account, saving login state, securing use and identifying a User during her activity on the Platform, including when registration or login is carried out via third-party services such as Google OAuth.
  • Preference Cookies — Cookies used to save the User's preferences on the Platform, such as language preference, display or other usage settings.
  • Analytics & Performance Cookies — Cookies used to measure, analyze and understand how the Platform is used, detect faults, improve the services and evaluate performance, including via Google Analytics.
  • Third-Party Measurement & Marketing Cookies & Tools — to the extent advertising, measurement or marketing components are embedded in the Platform, Take2 may also use third-party tools, including Google and Meta/Facebook, including Facebook Pixel, to measure the effectiveness of marketing activity, tailor advertisements, create audiences and analyze interactions with the Platform, subject to applicable law and the User's settings.

The types of Cookies and similar technologies actually used, their retention period and their precise purpose may change from time to time according to the embedding configuration on the Platform, the versions of the services used, the type of browser and device, and the scope of actions the User performs on the Platform, such as browsing, registration, login, purchase or making a payment.

The User may generally block, delete or manage Cookies via the settings of the browser or device she uses. However, blocking or deleting certain Cookies, and in particular essential Cookies, may impair the proper functioning of the Platform or prevent use of some of the services, including logging into the account, saving preferences or performing certain actions on the Platform.

Please note that information collected via such tools and services may be transferred, processed, backed up or stored outside Israel, including via cloud-service providers, analytics services, advertising services and third-party platforms, in countries where the level of protection of personal information may differ from that in Israel.

08.Advertising, Collection of Information by Third Parties & External Links

Without derogating from the foregoing in the section dealing with Cookies and similar technologies, Take2 may use third-party advertising, measurement, content and distribution services, and allow third parties to display, manage or operate advertisements, marketing content and sponsored content on the Platform. These services may use various tracking technologies to tailor content and advertisements, measure advertising effectiveness, analyze user behavior and create target audiences.

In addition, use of the Platform while the user is logged into a personal Google account may allow Google to cross-reference information about the user's activity across different devices (cross-device controls). Some of this information may be used to analyze user behavior and tailor advertisements. To manage or disable this option, you may use the settings of the user's personal Google account.

Furthermore, the Platform may include content, links, players, widgets or embeds of external platforms and services, including media, content-sharing and social-network platforms such as YouTube, TikTok, Spotify, Facebook, Instagram and the like. Use of such components may be subject to the privacy policy, terms of use and cookie policy of those external platforms, and they may collect information about the User and her activity, including via various tracking technologies, in a manner not within Take2's control and without Take2's access to the information collected independently by those third parties.

It is emphasized that the collection of such information is not managed by Take2, and to manage or disable the consumption of such content and ads, you may use the device settings and/or the websites of those relevant third parties.

09.Information Security

Take2 implements up-to-date systems and procedures for information security. While these systems and procedures reduce the risks of unauthorized penetration, they do not provide absolute security. Therefore, Take2 does not undertake that the Platform's services will be entirely immune to unauthorized access to the information stored in them.

10.Right of Access, Update & Deletion

Any information provided by the User through the Platform is provided of the User's free will and full consent, and will be stored in Take2's Database for the purposes set out in this Privacy Policy.

Under section 13 of the Protection of Privacy Law, 5741-1981, every person is entitled to review information about them held in a database. A person who has reviewed information about them and found that it is incorrect, incomplete, unclear or out of date may apply to the owner of the database with a request to correct or delete the information.

Deletion of the information will also be possible in other circumstances, in accordance with your rights under the Protection of Privacy Regulations (Provisions Regarding Information Transferred to Israel from the European Economic Area), 5783-2023, to the extent relevant in your case; and in this context, you may be entitled to request the deletion of the information collected about you which you did not transfer to us directly, to the extent this information is not required for law enforcement or for protection of state security in accordance with the law.

Notwithstanding the foregoing, Take2 may retain information about the User even after a deletion request, to the extent required or permitted by law, including for managing records, documenting actions performed on the Platform, managing or defending within legal proceedings, debt collection, preventing fraud or misuse, enforcing the Terms of Use, fulfilling a legal or regulatory obligation, or to protect a public interest or another legitimate interest of Take2.

11.Changes to the Privacy Policy

Take2 may update and/or change the Privacy Policy from time to time. Where material changes are made to the Privacy Policy, and in particular changes relating to the manner of use of personal information collected about Users, Take2 will act to publish an appropriate notice on the Platform and/or by another reasonable means, at its discretion, before the changes take effect or close to it. Non-material changes, including drafting, technical changes or changes required to adapt to legal requirements, may be made without such notice, and will take effect upon their publication in the updated Privacy Policy on the Platform. Continued use of the Platform after publication of the updated policy shall constitute consent to the Privacy Policy as updated from time to time.
